1. Agreement to these terms

These Terms of Service (“Terms”) are an agreement between you and [FULL LEGAL ENTITY NAME], trading as Starup Game. They govern your use of our games, websites, software, communities, and related services (together, the “Services”).

By downloading, accessing, or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services. App-store terms may also apply and will control only where they conflict on store-specific matters.

2. Eligibility and accounts

You must meet the minimum digital-consent age in your country. If you are under the age of legal majority, a parent or guardian must review and accept these Terms for you. Our general-audience games are not directed to children under 13.

If a Service offers an account, provide accurate information, keep credentials secure, and tell us promptly about unauthorized access. You are responsible for activity through your account unless applicable law says otherwise. You may not sell, share, or transfer an account without our written permission.

3. Limited right to play

We grant you a personal, limited, revocable, non-exclusive, non-transferable license to install and use the Services for private, non-commercial entertainment, subject to these Terms. Starup Game and its licensors retain all rights in the Services, including code, artwork, characters, music, trademarks, and game data.

You may not copy, distribute, publicly perform, sell, lease, sublicense, modify, reverse engineer, extract assets from, create derivative works of, or bypass security in the Services except where applicable law expressly permits that activity.

4. Player conduct and fair play

Keep Starup Game welcoming and fair. You agree not to:

• Cheat, automate gameplay, exploit bugs, manipulate rankings, or use unauthorized software.
• Interfere with servers, security, networks, other players, or normal operation of the Services.
• Harass, threaten, impersonate, deceive, or publish unlawful, hateful, sexual, or privacy-invasive content.
• Buy, sell, trade, or transfer accounts or virtual items outside features we expressly provide.
• Use the Services for advertising, commercial activity, fraud, money laundering, or other unlawful purposes.
• Attempt to obtain another person’s password, payment information, or personal data.

We may investigate suspected violations and limit, suspend, or terminate access when reasonably necessary to protect the Services, players, or others. Where practical and legally required, we will provide notice and an appeal path.

5. Virtual items, purchases, and refunds

Some Services may offer virtual currency, boosts, lives, decorations, or other digital content (“Virtual Items”). Virtual Items are licensed, not sold; have no cash value outside the Services; and cannot be redeemed or transferred except through features we authorize.

Prices and offers may change. Purchases are processed by the applicable app store or payment provider under its terms. Taxes may apply. Refunds are handled by the store and applicable law. We may adjust or discontinue Virtual Items as the game evolves, but will not limit non-waivable consumer rights.

6. User content and feedback

You retain ownership of content you create and submit. You grant us a worldwide, non-exclusive, royalty-free license to host, reproduce, display, adapt, and distribute that content only as reasonably needed to operate, improve, promote, and protect the Services. This license ends when the content is deleted, except for cached, shared, legally retained, or previously used promotional copies as allowed by law.

Do not submit content you do not have permission to use. Feedback and ideas may be used without restriction or compensation, but we will not claim ownership of your unrelated intellectual property.

7. Updates, suspension, and ending service

Games change over time. We may update features, balance, content, device requirements, or availability. We may suspend a Service for maintenance, security, legal, or operational reasons. If a game closes, we will provide reasonable notice where practical and required.

You may stop using the Services at any time and request account deletion through support. Terms that by their nature should continue, including ownership, disclaimers, limitations, and dispute provisions, survive termination.

8. Disclaimers and liability

To the extent permitted by law, the Services are provided “as is” and “as available.” We do not promise that they will always be uninterrupted, error-free, secure, or compatible with every device. Nothing in these Terms excludes warranties or remedies that cannot lawfully be excluded.

To the extent permitted by law, Starup Game is not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, goodwill, or opportunity arising from the Services. Our total liability for claims relating to the Services will not exceed the greater of the amount you paid us for the applicable Service during the previous six months or [LOCALLY APPROPRIATE FLOOR]. These limits do not apply where prohibited by law or to liability that cannot be limited.

9. Governing law and disputes

Contact support@starup.game first so we can try to resolve a concern informally. These Terms are governed by the laws of [GOVERNING JURISDICTION], without regard to conflict-of-law rules. Courts located in [VENUE] will have jurisdiction, except where consumer law gives you the right to use your local courts.

Do not add mandatory arbitration or a class-action waiver without jurisdiction-specific legal review and a compliant opt-out process.

10. Changes and contact

We may revise these Terms. If a change materially affects your rights, we will provide reasonable notice before it takes effect where required. Continued use after the effective date indicates acceptance, unless law requires another form of consent.
